    • (4) A person is exempt from wearing a bicycle helmet under subsection (1) or (2) if the person is carrying a current doctor's certificate stating that, for a stated period—
      • (a) the person can not wear a bicycle helmet for medical reasons; or
      • (b) because of a physical characteristic of the person, it would be unreasonable to require the person to wear a bicycle helmet.
    • (5) A person is also exempt from wearing a bicycle helmet under subsection (1) or (2) if—
      • (a) the person is a member of a religious group; and
      • (b) the person is wearing a type of headdress customarily worn by members of the group; and
      • (c) the wearing of the headdress makes it impractical for the person to wear a bicycle helmet.

    • For the purposes of rule 256(1) and (2) (Bicycle helmets), a person of the Sikh religion who is wearing a turban is exempt from wearing a bicycle helmet.

    • (3) Subregulation (2) does not apply to a person who —
      • (a) is a member of a religious or cultural group and who is wearing a headdress customarily worn by members of that group, if the wearing of that headdress makes it impractical for a person to wear a protective helmet; or
      • (b) has been exempted in writing by the CEO from wearing a protective helmet for medical reasons, and is complying with any terms and conditions of that exemption.
    • (4) The CEO may at any time, by notice in writing to the person, amend or revoke an exemption granted under subregulation (3)(b).

    • Helmets for cyclists
    • (1) For the purposes of rule 256, the requirement to wear an approved bicycle helmet does not apply to a person over 17 years of age if he or she is riding or being carried on a bicycle:
      • (a) on a public place;
      • (b) on a bicycle path or shared path; or
      • (c) in an area declared by the Minister, by notice in the Gazette, to be a bicycle helmet exemption area.
    • (2) In this regulation, a bicycle path does not include a bicycle lane that is not separated from the part of the road used by motor vehicles by a physical structure or barrier in addition to or in substitution for the lane line.
    • (3) In this regulation and rule 256, an approved bicycle helmet is a helmet that:
      • (a) complies with Australian Standard AS/NZS 2063:2008 – Bicycle helmets; or
      • (b) is approved by the Registrar.

    • (1) The rider of a bicycle must wear an approved bicycle helmet securely fitted and fastened on the rider's head unless—
      • (a) the Corporation has issued a certificate to the rider under subrule (4) and the rider complies with subrule (5); or
      • (b) the rider is exempt from this rule under subrule (6).
    • (2) (3) about passanger
    • (4) The Corporation may issue a certificate stating that it would be impractical, undesirable or inexpedient that the person named in the certificate wear a bicycle helmet while riding on, or being taken as a passenger on, a bicycle.
    • (5) A certificate issued under subrule (4) must be—
      • (a) carried by the person to whom it applies while the person is riding on, or being taken as passenger on, a bicycle; and
      • (b) produced by the person to a police officer or authorised person when requested to do so.
    • (6) A person is exempt from wearing a bicycle helmet under subrule (1) or (2) if—
      • (a) the person is a member of a religious group; and
      • (b) the person is wearing a type of headdress customarily worn by members of that group; and
      • (c) the wearing of the headdress makes it impractical for the person to wear a bicycle helmet.
